Acceptable Use Policy (AUP)

This Acceptable Use Policy outlines conduct and actions which are prohibited whilst using our
websites and services.

Failure to adhere may result in service suspension or termination.

 

1) Basis to use the website or service:
The Customer or Web Visitor must agree that they have read and understood this Acceptable Use Policy, our Terms of Service and Privacy Policy. Failure to agree to the Agreements listed above, shall result in the Customer or Web Visitor not being authorised to use our websites or services.


2) Abusive, Excessive or Disruptive Use:
By visiting our websites and using our services, the Customer agrees that they shall not:

  • Probe, scan or test for vulnerabilities in any of our services, networks or websites
  • Breach or bypass any security or authentication measures
  • Brute-force our authentication or e-commerce pages
  • Impersonate a user, by using their credentials
  • Interfere with or disrupt any user, host or network
  • Take action that imposes an unreasonable load on either our infrastructure or our thirdparty providers. (We reserve the right to determine what is reasonable)
  • Decompile or reverse engineer any part of our websites or services, in an effort to access,
    misuse, damage or destroy such a website or service


3) Unauthorised Monetary Gain, Illegal Conduct:
3.1) Our services shall not be used in connection with any cryptocurrency production i.e. bitcoin if it interferes with the functional operation of the service. If we discover or detect disruption of any kind as a result of your use of the service, we reserve the right to suspend or terminate your service.
3.2) Our services are not to be used for performing actions, conducting activities or storing data which is contrary to UK Law. If it is found that your use of the service is illegal, we shall suspend your service and contact the relevant law enforcement authorities.
3.3) Our services are not to be used for scamming or spamming activities, including but not limited to: phishing websites, Unsolicited Bulk Email (UBE), Pyramid or Ponzi Schemes, Business Email Compromise (BEC) etc or the storing or distribution of stolen content or credentials.


4) User Responsibilities:
4.1) It is the responsibility of the Customer to remain compliant with UK Law and they warrant that their use of the websites and services is not contrary to UK Law. Failure to remain compliant, shall see the Customer liable to service suspension or termination.
4.2) Our websites and services may allow customers or web visitors to share, re-share or publish user generated content to websites and social media. We do not control, are not responsible nor liable for any content shared or distributed by these systems.

4.3) On some of our services, such as web hosting, we employ anti-virus scanning, to ensure that content which reside on our hosting servers are free from harmful content, this is to reduce the chances of a bad actor distributing virus-like content on our servers. By using the service, you agree to your content being scanned. You can opt out of this scanning, by deleting the content from our servers.
4.4) The service is marketed and sold exclusively for those who are at least thirteen (13) years of age. Customers who are under the age of thirteen (13) must seek parental consent in order to use the Service. Parents or guardians whom wish to issue consent on behalf of someone under the age of thirteen (13) who is in their care must email other@bolthost.co.uk


5) Governing Law:
The website and the Service are operated and controlled from the United Kingdom and therefore are governed by and construed in accordance with the laws of England and Wales.


6) Indemnification:
To the fullest extent permitted by law, you agree to indemnify and hold harmless Bolt Host, affiliates and their directors, officers, employees, contractors, service providers and agents from and against all legal proceedings, damages, losses, liabilities, costs, claims, demands, fines, awards and expenses of any kind (including without limitation reasonable attorneys' fees and costs) arising out
of or related to: (a) your breach of this agreement; (b) your user content, your sites and your eCommerce; (c) any claims by, on behalf of or against your end users; (d) your violation of any law or regulation or the rights or good name of any third party. This indemnity covers any liability or expense arising from claims, losses, damages, judgments, fines, litigation costs, and legal fees.
